We are committed to protecting your privacy online. We appreciate that you do not want the personal information you provide to us distributed indiscriminately and here we explain how we collect information, what we do with it and what controls you have. By using the App or browser, you consent to the collection and use of information in accordance with this privacy policy.

Information we may collect from you

We may collect and process the following information about you such as your photo, name, email address, postal address and telephone number that you provide by registering on the App or browser. We can also keep a record of any data upload by you via the App or browser like your preferences. We may request any information or enter into any competition or promotion we may sponsor. We keep track of the details of every transaction made by you through the application or website.

When you have installed the eSmartGuard user App or browse the form via browsers on your mobile or any device, we collect a unique identification number that we assign to you, your IP address, phone model, the type of internet browser you use and operating system. In connection with the Applications, with your permission, we may collect your precise location information from your mobile device, including when you are not using the eSmartGuard User App. “Mobile Information” together with eSmartGuard Account Information, Third Party Information, Usage Information, Login Information, Credentialing Information, License Information and Biometric Information, are collectively referred to as “User Data”.

How we utilize your information

We will use the information you provide to help us to build a profile of your preferences so we can offer you events and services you are interested in. The Visitor/Guest data is recorded for future audits and helps your customers login more swiftly. The information also enables us to process your requests and to provide you with the services and information offered through the App and browser and which you request. It helps us to administer your account with us to verify and carry out financial transactions with your permission.

Also, the Company may use User Data for the following purposes:

  • to communicate with you about new features or promotions of the Company or Service
  • to communicate with you about new features or promotions of the Company or Service
  • to prevent fraud or potentially illegal activities
  • to enforce our Terms of Use
  • to solicit your feedback to improve the Service and your experience using it
  • to administer and improve the Service, including by creating test reports on the User Data we collect, and

We have security measures in place to attempt to protect against the loss, misuse and alteration of personal information under our control. For example, our security and privacy policies are periodically reviewed and enhanced as necessary and only authorised personnel have access to personal information. Whilst we cannot ensure or guarantee that loss, misuse or alteration of information will never occur, we use all reasonable efforts to prevent it

We work hard to ensure the safety of User Data using teams of engineers, automated systems and advanced technology such as encryption, digital certificates and machine learning. Additionally, We maintain strict administrative, technical and physical safeguards to protect the User Data that we collect about you against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use.

License Information

In certain cases, you may have the opportunity to verify your identity by using the eSmartGuard User App or browser to scan your Aadhar, driver’s license or another government-issued form of identification. If you choose to use this identity verification function, we will collect certain of your personal information directly from your Aadhar or another form of identification, such as your first and last name, date of birth, picture and zip code (“License Information”).

Biometric Information

We may collect, with your consent, your fingerprint, voiceprint or facial profile which are considered biometric data (the “Biometric Information”). This Biometric Information may be used to validate your Credentialing Information when logging into the Service on a new device and to provide Administrators, eSmartGuard Mobile Users and other Users with a biometric means of confirming Credentialing Information.

Web Analytics

We may use web analytics services on the website and Apps, such as those of Google Analytics. The service providers that administer these services use technologies such as cookies to help us analyse how visitors use the Site. The information collected through these means (including IP address) is disclosed to or collected directly by these service providers, who use the information to evaluate the use of the website. How We Share Your Information (User Data)

We may share User Data in the following cases:

  • With Affiliates and Our Third Party Service Providers: We may share your User Data with our affiliates and third-party service providers. Except as otherwise outlined in this section, we will only share your User Data with any such parties in connection with the administration of the Service or to improve your experience with the Service.   • With Administrators: We may share some specific User Data with the Administrator of an eSmartGuard Network that you are a member of. Such User Data may include your Usage Information, your Credentialing Information, and your Mobile Information (including your Location Data).
  • As required by Law: We may disclose any User Data when we believe, in our sole discretion, disclosure is necessary or appropriate to comply with any applicable law, regulation, legal process or governmental request.
  • To Protect Our Legitimate Business Interests: We may disclose User Data when we believe, in our sole discretion, disclosure is necessary to protect the Company’s legitimate business interests.
  • In Connection with a Sale of Our Business: We also reserve the right to transfer User Data in the event we sell or transfer all or a portion of our business or assets. Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use the User Data in a manner that is consistent with this Privacy Policy. Your Privacy Rights and Choices

To stop the Service from collecting your Usage Information at any time, uninstall the eSmartGuard User App from all of your devices or do not use browsers to fill the details. However, since eSmartGuard is a cross-platform Identity Management System, significant information would be stored and distributed as deemed necessary. If applicable law requires, we will provide you with access to the User Data we have retained about you and the ability to review, correct, update, block or delete the information where it is inaccurate. Subject to applicable law, we may limit or deny access to your User Data where providing such access is unreasonably burdensome or expensive under the circumstances. Camera

The camera functionality is essential for the purpose of user identification. By capturing the user's face, we can verify whether the saved server-side photo of the same user matches the current image. This process ensures a reliable and secure authentication mechanism for our application.

All Media Access

Granting access to all media on your device enables us to facilitate various crucial features such as uploading photographs of content, enabling communication with stakeholders, and performing tasks like marking attendance, setting profile photos or images, and creating tickets. These functionalities require access to your device's gallery, ensuring seamless and efficient user experiences.

Location

Obtaining permission to access your device's location is crucial for ensuring the security and integrity of our application. It enables us to prevent misuse of the app and allows us to check whether users are marking attendance within designated geofence areas. This information helps us maintain a secure environment and deliver enhanced functionality based on location-based services.
